ODC v. Baldwin, 2587 DD3 (Disciplinary Proceeding)
The Pennsylvania Supreme Court will consider the Disciplinary Board of the Pennsylvania Supreme Court’s recommendation that Former Supreme Court Justice Cynthia Baldwin be publicly censured for alleged misconduct arising from her representation of Penn State University and former university officials.
Ms. Baldwin served as Penn State University’s general counsel during the grand jury investigations of Jerry Sandusky and three former university officials related to the highly publicized child molestation charges against Sandusky. The petition for discipline was filed in 2017 based on allegations that Ms. Baldwin failed to disclose a conflict of interest arising from her representation of Penn State to the university official clients, and that she violated attorney-client privilege by disclosing confidential client information during her own grand jury testimony.
While a hearing committee recommended dismissal of the petition for discipline, the Disciplinary Board nonetheless recommended public censure for the alleged misconduct.
